12 states are suing President Trump over his tariffs, claiming it interferes with the congressional ability to regulate foreign trade and commerce. The lawsuit specifically claims that Trump, "By claiming the authority to impose immense and ever-changing tariffs on whatever goods entering the United States he chooses, for whatever reason he finds convenient to declare an emergency, [he] has upended the constitutional order and brought chaos to the American economy". The 12 states suing are Arizona, Colorado, Connecticut, Delaware, Illinois, Maine, Minnesota, Nevada, New Mexico, New York, Oregon and Vermont. Article I of the Constitution gives Congress the ability "To regulate Commerce with foreign Nations, and among the several States," so it is likely the claim that Trump is “upending the constitutional order” is correct, but the outcome of the lawsuit is still unclear.
