Supreme Court Considers Religious Charter School

On April 30, 2025, the Supreme Court, with a conservative majority, seemed likely to approve the Catholic Church’s argument for a religious charter school. Amy Coney Barrett, a conservative justice on the Supreme Court, has recused herself from the case. This case has been debated because the Constitution says that the government cannot establish or endorse religion, but also says that individuals have the right to freely practice religion. The argument on the liberal side has been that the government should not be involved in religion, while the conservative side has claimed that establishing a religious charter school would be legal because of individuals’ rights to practice religion freely. According to Oklahoma(the state trying to approve the religious charter school)’s Attorney General, SCOTUS’s decision could have “profound consequences”. This case will be a major test of separation of church and state.
